  4. DISCLAIM ALL WARRANTIES RELATING TO THIS SOFTWARE, WHETHER EXPRESSED OR
  5. IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF
  6. MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, AND ALL SUCH
  7. WARRANTIES ARE EXPRESSLY AND SPECIFICALLY DISCLAIMED. NEITHER THE AUTHORS OF
  8. THE SOFTWARE NOR ANYONE ELSE INVOLVED IN THE CREATION, PRODUCTION, OR
  9. DELIVERY OF THIS SOFTWARE SHALL BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL,
  10. OR INCIDENTAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE SUCH
  11. SOFTWARE EVEN IF THE AUTHORS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH
  12. DAMAGES OR CLAIMS. IN NO EVENT SHALL THE AUTHORS' LIABILITY FOR ANY DAMAGES
  13. EVER EXCEED THE PRICE PAID FOR THE LICENCE TO USE THE SOFTWARE, REGARDLESS
  14. OF THE FORM OF CLAIM. THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE 
  15. QUALITY AND PERFORMANCE OF THE SOFTWARE.

  17. This agreement shall be governed by the laws of the Province of British Columbia
  18. and shall inure to the benefit of Andrzej Brzezinski and Marek Kosznik and any 
  19. successors, administrators, heirs and assigns. Any action or proceeding 
  20. brought by either party against the other arising out of or related to this 
  21. agreement shall be brought only in a Provincial or Federal Court of 
  22. competent jurisdiction located in Vancouver, B.C. The parties hereby 
  23. consent to in personam jurisdiction of said courts.
